Welcome to Picturize
We are happy to have you as a user on our platform and to be a part of our fast-growing community. These terms of use (the “Terms”) govern the use of Picturize, except where expressly stated that separate terms apply, and provide information about our Service (the “Service”) as outlined below. Whenever you use Picturize, you agree to these Terms.
A) The Picturize Service
Our Service includes all of the Picturize products, features, applications, services, technologies, and software that we provide to advance our mission: To share real and recent photos and impressions with the world and to find such photos from all kind of places. Our Service is made up of the following aspects:
Offering an opportunity to create, inform, stay up to date and discover
Our planet and its people are diverse. The goal of Picturize is to give you an accurate and realistic picture of our world, its people, current and past events and happenings. Our systems are designed to achieve this goal.
Imaging a real picture of the world, but in a positive, inclusive, and safe environment
We develop and use tools and offer resources to our users that help to make their experiences positive and inclusive. Our teams and systems work to combat abuse and violations of these Terms and our other policies, as well as harmful and deceptive conduct. We use all the information and systems we have to try to keep our platform as secure as possible.
Developing and using technologies that help us consistently serve our community
Organizing and analyzing information for our growing community is central to our Service. Technologies like artificial intelligence and machine learning give us the power to apply complex processes across our Service. Automated technologies also help us ensure the functionality and integrity of our Service.
Ensuring access to our Service.
To operate our global Service, we must store and transfer data across our systems around the world, including outside of your country of residence. The use of this global infrastructure is necessary and essential to provide our Service. This infrastructure may be owned or operated by us or various third-party providers. Research and innovation
We use the information we have to develop, test, and improve our Service and collaborate with others on research to make our Service better and contribute to the well-being of our community. This includes analyzing the data we have about our users and understanding how people use our Services, for example by conducting surveys and testing and troubleshooting new features.
How our Service is funded
Instead of paying to use Picturize, by using our Service you acknowledge that we can show you advertisements that businesses and organizations pay us to promote. We allow advertisers to tell us things like their business goal and the kind of audience they want to see their advertisement and we show their advertisement to people who might be interested. We provide advertisers with reports about the performance of their advertisement, but we do not share information that directly identifies you and we do not sell your personal data to them. The Data Policy
Providing our Service requires collecting and using your information. The Privacy Policy explains how we collect, use, and share your personal data.
B) How to use Picturize
We want our Service to be as open and inclusive as possible, but we also want it to be safe, secure, and in accordance with the law. For this reason, there are some rules to follow when joining our community and using our Services:
Who can use Picturize
If you want to join our community, you need to commit to a few restrictions:
You are at least 13 years old.
You must not be prohibited from receiving any aspect of our Service under applicable laws.
Your account has not been previously disabled for violation of these Terms, any of our policies or the law.
What you are not allowed to do
If you have joined our community and use our Services, it is necessary that you follow these rules:
Even if Picturize is made to share true photos and real impressions from all kind of places, it is strictly forbidden to post unlawful, misleading, or illegal content. Photos or information with violent, animal cruelty or sexual content will be deleted and the respective user will be banned. Reporting to authorities and the initiation of legal action against the user in question are expressly reserved.
It is not allowed to use the Service in a way which contradicts the idea of Picturize or impairs the experience of other users. This includes, for example, the repeated posting of a photo with the same content and without added value.
It is not allowed to do anything to interfere with or impair the intended operation of the Service. This includes misusing any reporting, dispute, or appeals channel, such as by making fraudulent or groundless reports or appeals.
It is not allowed to impersonate others or provide inaccurate information. In order to run the Service, users must provide us with accurate and up to date information (including registration information), which may include providing personal data. In this respect, you may not impersonate someone or something you are not and you are not allowed to create an account for someone else.
It is not allowed to create accounts or access or collect pictures and information in unauthorized ways. This includes creating accounts or collecting photos and information in an automated way without our express permission.
It is not allowed to sell, license, or purchase any account or data obtained from us or our Service. This includes attempts to buy, sell, or transfer any aspect of your account (including your username); solicit, collect, or use login credentials or badges of other users; or request or collect Picturize usernames, passwords, or misappropriate access tokens.
It is not allowed to post someone else’s private or confidential information without permission or do anything that violates someone else's rights, including privacy rights or intellectual property rights. This includes the posting of content that is forbidden to share or to make public under applicable national laws.
It is not allowed to modify, translate, create derivative works of, or reverse engineer our products or their components without our express consent.
Users who violate (or help or encourage others to violate) these Terms or our other policies can be blocked without notice. We expressly reserve the right to take appropriate legal action.
C) Your permissions
You acknowledge that you have to give us the following permissions that we can provide the Service:
When sharing, posting, or uploading content that is covered by intellectual property rights on or in connection with our Service, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content. This license will end when your content is deleted from our systems. It’s possible to delete content individually or all at once by deleting your account. You agree that we can download and install updates and modifications to the Service on your device.
D) Other rights
You further acknowledge to be compliant with the following terms:
If you use content covered by intellectual property rights that we own and make available in our Service, we retain all rights to such content.
It is not allowed to use our intellectual property and trademarks or similar marks with our prior written permission.
It is required to obtain written permission from us or under an open source license to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.
E) Removal of content and Termination of provision of the Service
If we believe that your posted content or information or your conduct while using the Service violates these Terms or our policies, or if we are required to do so by law, we may remove such content or information that you have posted. We may refuse to provide all or part of the Service, or immediately discontinue providing the Service, in order to protect our community or our services, or if you pose a risk or legal exposure to us, if you violate these Terms or our policies, if you repeatedly infringe the intellectual property rights of others, or if we are required to do so by law. We may also terminate or modify the Service, remove or block content or information shared on our Service, or stop providing all or part of the Service if we determine that it is reasonably necessary to do so in order to avoid or mitigate any adverse legal or regulatory impact on us. F) Removal of content upon request
Users have the possibility to report inappropriate to content via the Service to report@picturize.app. Our investigation team will check whether the notification is justified, delete the content if necessary and take further measures against the user in question.
G) Our liability
We will use reasonable care to provide you with our Service and to maintain a secure and error-free environment, but we cannot guarantee that our Service will always operate without interruptions, delays or imperfections. We will not be responsible for any loss not caused by a breach of these Terms or otherwise caused by our actions; for any loss that was not foreseeable to you or us at the time you entered into these Terms; for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content posted on our Service by others; and for events beyond our control. Furthermore, we are not liable for consequential or indirect damages, such as unrealized savings, our own expenses, third party claims, losses due to loss of data, etc. resulting from the use of our Service.
H) Miscellaneous
By using our Service, you also agree to the following principles:
If any aspect of this Terms is unenforceable, the rest will remain in effect.
We reserve all rights not expressly granted to you.
These Terms not give rights to any third parties.
You cannot transfer your rights or obligations under these Terms without our consent.
Our rights and obligations can be assigned to others. For example, this could occur if our ownership changes (as in a merger, acquisition, or sale of assets) or by law.
I) Disputes
If a claim or dispute arises out of or relates to your use of the Service as a consumer, it is agreed that you may file your individual claim or dispute against us, and we may file our claim or dispute against you, in any competent court in the country of your main residence that has jurisdiction over your claim or dispute, and the laws of that country will apply without regard to conflict of law provisions.
If a claim or dispute arises between us that relates to use of the Service in any other capacity, including, but not limited to, access or use of the Service for a business or commercial purpose, you agree that any such claim or dispute must be resolved in a competent court of the city of Zurich (Zurich 1), Switzerland and that Swiss law will apply without regard to conflict of law provisions.
J) Unsolicited material
We appreciate your feedback or suggestions, but note that we may use them without any restrictions or obligation to compensate you for them, and are under no obligation to keep them confidential.
K) Updating these Terms
We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service) at least 30 days before we make changes to these Terms and give you an opportunity to review them before they go into effect. Then, if you continue to use the Service, you will be bound by the updated Terms. If you do not want to agree to these or any updated Terms, you can delete your account in the Picturize app.
